SAC dismissed case against Saroori, Tara




CM was R&B(PWD) Minister when 2000 works allotted without tendering

Jammu, 06 February: - State Accountability Commission (SAC) today gave the clean chit to former Minister and MLA Inderwal Mr. G. M. Saroori by dismissing the case leveled against him.

It was alleged that during his Minister ship near about two thousand works were allotted without tendering. The one namely Mr. Mushtaq Ahmed resident of Srinagar alleged that the former minster sanctioned two thousand works in PWD R& B department without formal tendering upon which SAC conducted the detailed enquiry and came to the conclusion by dismissing the case completely.

Mr. Saroori in his reply explained to SAC that allotting the work was not his job it was solely the job of officers concerned besides chief accounts officer of finance department and financial advisor’s responsibility to allot the work or not after following the relevant codal formalities for which they were meant and it was the job of the department whether to allot the formal tender or to take the work at their hands at their own whim or freedom.

SAC sent some relevant papers and a few as proof and sent to the former R& B minister to ascertain and prove his argument explaining his position to SAC. Commission further asked the former minister about his sereneness regarding the allotment of works and even after knowing such why he did intervene and stopped such practices without tendering.

In his defense Mr. Saroori revealed the facts to the commission by saying that according to the orders attached with few papers during the months of April, May & June 2009 the information sought during the period, he was not holding the charge of PWD /R&B Department at that time.

In fact it was the Chief Minister himself holding the charge and running the affairs. In front of the commission ‘s full bench comprised of justice Hakim Imtiaz and Justice Nargotra, Mr. Saroori’s advocate Tahir Shamsi put the arguments with authority by revealing that the enquiry period was being holded by Chief Minister Jammu and Kashmir by himself either he should be summoned for the answering or by dismissing the case immediately.

The advocate further put the things lucidly in front of the commission that according to the papers put forth by commission such near two thousand works were conducted from 2006 to 2011 and the former Minister Mr. Saroori holded the portfolio for an year and few days.

In his further details he disclosed that during the visits of chief minister to Srinagar the department was told to execute the work at their own disposal without following the codal formalities like tendering.

According to RTI information which commission put forward reveals the statement of an engineer by saying that such works were ordered none by else chief minister himself by asserting that sometimes such works need to execute by keeping the interest of the people and the development of the area in mind.

After hearing all such argument put forward by advocate SAC dismissed the case completely and gave the clean chit.

Meanwhile the Deputy Chief Minister Mr. Tara Chand in his capacity as Minister Incharge Urban Local Bodies had made fake and illegal appointments in utter violation of constitutional scheme of the Government Order Number 1423 of GAD dated October 14, 2009. Itwas also given the clean chit by dismissing his case alleged upon him regarding some matters during his tenure. In both the cases the complainant was from the same family so both the cases were dismissed on the same time. Advocate Mr. Tahir Shamsi also appeared for Deputy Chief Minister’s this time.

According to sources the person put forward the complaint neither appeared in court for the last one and half year nor succeeded in providing the concrete proofs to the court.
